Where it may stand

Lawful to vend is not the same as anywhere you like.

A market can permit unattended sale and still leave you almost nowhere to put the machine. The United States permits it, and confines it to premises nobody under 21 may enter at any time — which removes hotels, gyms, offices and shops in a single clause.

So placement is a third question, after whether the product may be sold and whether it may be vended.

Four ways placement is constrained

And they cost different things.

The venue must exclude minors

Placement is confined to premises where nobody under the age limit is admitted, so everyone in front of the machine is already of age. The venue does the verification work, not the hardware.

What it costs you

This is the single biggest constraint on an estate. It removes hotels, gyms, offices, student accommodation, transport hubs and retail in one move, and leaves bars, nightclubs, casinos and private clubs.

  • United StatesA qualified adult-only facility — nobody under 21 present or permitted to enter at any time. Everywhere else the sale must be face to face.
  • SpainBars, restaurants and nightclubs where access by minors is controlled. Explicitly prohibited in shopping centres, shops and open public spaces.

Only a licensed retailer may operate it

The machine is not placed by an operator into a third party’s venue at all. It belongs to a licensed retailer, sited at or beside their own premises, under an authorisation that attaches to them.

What it costs you

It changes who the customer is. There is no site agreement to negotiate with a venue, because the venue cannot host one — the buyer is the licensed retailer.

  • ItalyInstalled only by the monopoly administration and by licensed retailers, outside their own premises and in the immediate vicinity, with authorisation from the inspectorate.
  • AustriaMachines at a shop’s own premises remain permissible in principle, but only where operated by a Tabaktrafik and only for approved products — and nicotine products left the machine channel entirely on 1 April 2026.

Specific places are excluded outright

Sale is prohibited in named settings regardless of the venue’s general character or any age check the machine performs.

What it costs you

Usually straightforward to design around, but it eliminates categories an operator might otherwise treat as obvious — hospitals and campuses in particular.

  • CzechiaSale is prohibited outright in healthcare facilities, schools, and at events intended for children.
  • ThailandVending is prohibited generally, and sale is separately prohibited in schools, playgrounds and healthcare facilities.

The machine itself must be built differently

Placement is permitted, but a display prohibition governs what the machine may show — which decides the hardware before the site is even chosen.

What it costs you

A glass-fronted machine cannot be used. Specify closed-front, select-by-code units for these markets, or the estate is unusable on arrival.

  • DenmarkNicotine pouches fall under the same display prohibition as cigarettes, and it extends to images of the products — so a machine showing packs does not comply.
  • SwedenNo display prohibition, but the moderation standard excludes screens, illuminated signs and lighting inside cabinets — which reaches a backlit machine as readily as a backlit cooler.

Before signing a site agreement

Six questions, in the order they bite.

Answered in this order, a bad market is eliminated before anyone has quoted for hardware.

    Is unattended sale lawful here at all?

    Eleven of the markets on this map prohibit selling nicotine products from a machine. Establish this before anything else, because nothing downstream matters if the answer is no.

    May this class of venue host one?

    Where placement is confined to premises excluding minors, a hotel or a gym is not a candidate however good the site looks commercially.

  3. 03

    May we operate it, or only a licensed retailer?

    In monopoly-channel markets the operator has to hold the licence. A site agreement with a venue is unenforceable if the venue was never permitted to host the machine.

  4. 04

    What must the machine not show?

    A display prohibition decides the hardware. Discovering it after the units are bought is the expensive order to find out in.

  5. 05

    What has to be notified, authorised or permitted first?

    Czechia wants the age-verification system notified in advance; Italy requires installation authorisation; Spain requires the venue to hold a sales permit. These are prerequisites, not paperwork to follow later.

  6. 06

    When does the answer change?

    Several of these markets have dated commencements or drafted bills. A site agreement that outlives the permission is a liability, so check the market page for what is scheduled.

The venue rule is the expensive one

Of the four, confinement to premises that exclude minors is what most often kills an estate that looked viable on paper. It is not a restriction on how the machine works — no amount of verification technology satisfies it — and it removes the venue types that carry the best footfall for this product.

It is also the constraint that disappears entirely with a non-nicotine payload, because a caffeine pouch is food and the age rule does not attach to it.
