Nicotine pouches
Lawful to buy and possess at the time of checking. A draft Real Decreto from the Ministerio de Sanidad would cap nicotine at 0.99 mg per pouch and restrict flavourings, with transition periods for manufacturers and retailers — but it had not entered into force. For scale, pouches produced in Sweden may lawfully reach 20 mg there, so the proposed cap would reshape the product entirely.

Permitted for tobacco under a well-established regime, and the venue type suits this business: machines may stand only where access by minors is controlled — bars, restaurants and nightclubs — and are prohibited in shopping centres, shops and open public places. The machine must show a health warning on its face, carry a mechanism preventing access by minors, sit in an authorised establishment under the direct and permanent supervision of its owner, and be an authorised registered model; the venue needs a point-of-sale permit. The open question is that this regime is written for productos del tabaco, and pouches contain no tobacco, so there is no specific authorisation route for them today. Confirm with the Comisionado para el Mercado de Tabacos, and treat the pending Real Decreto as the thing that will settle it.
