Nicotine pouches

Lawful and newly regulated, after several years in which they were sold in tobacconists and kiosks with no regime at all. The 2026 State Budget brought nicotine pouches into the special consumption tax for the first time, and the government approved a specific regime alongside it: sale prohibited to minors, advertising prohibited, online sale prohibited, mandatory health warnings modelled on the tobacco rules with an information leaflet in each pack, and a ceiling of 12 mg of nicotine per pouch. Portugal moved ahead of the EU here — the tobacco products directive is not due for review until 2027 or 2028.

May it be sold from a machine?

Closed. The regime confines sale to authorised tobacco establishments, in a reserved space and with the seller intervening in the transaction — which is the opposite of unattended retail — and it prohibits commercialisation through automatic machines by name, alongside hospitals, schools, sports facilities, public buildings and public transport. Note that this detail comes from national press reporting the government decision rather than from the decree text; confirm with the Direção-Geral da Economia before treating it as settled, but plan on the market being shut to machines.

May it be shown — shelves, cases, branded coolers?

Constrained rather than closed. Advertising is prohibited and sale happens in a reserved space with the seller involved, so a branded self-service fixture is not the available route; a plain unit behind the counter in an authorised establishment is a different question worth putting to the regulator.
